Tectonic Shifts: Mapping New Landscapes in Administrative Law

This CLE will explore the status and evolution of deference to federal and Nevada agencies. Over the past four years, there have been notable changes in the federal landscape (e.g., the major questions doctrine and elimination of the Chevron Doctrine).  Understanding how the landscape of deference to agencies has evolved at the federal and Nevada level is critical for all practitioners who practice before agencies.

Learning Objectives:

1. Understand the legal framework of the major questions doctrine.

2. Understand the legal framework of deference to agencies in a post-Chevron environment.

3. Understand how lower federal courts and Nevada courts have been undergoing these major changes.


FACULTY

Jared Wigginton works as assistant staff counsel at the PUCN. Before joining the PUCN, Jared worked as an environmental and energy attorney representing large businesses and national trade associations before federal and state courts and agencies. Before that, Jared worked as a judicial clerk for two years with the Honorable Michael L. Douglas (retired) on the Nevada Supreme Court.
